Law Professor Obama’s approach to due process: assassination

Ok, this is bizarre – WaPo is reporting the Obama team is choosing to kill alleged terrorists in the field rather than capture them because they are fearful of the complex legal issues that surround interrogation of detainees, even over the objections of the US military!

It appears that Obama is so fearful that he may have to reverse his decision to close Guantanamo he is choosing instead to “kill the bastards where they stand.”

One of the Administration’s top lawyers, and my former law school professor, Harold Koh of the State Department has apparently made up his mind (click on minute 63:30) that the killings are legal because we are in an “armed conflict” with people who do not obey the laws of war.

Of course, that is hardly the issue now, is it?

Under Obama, more targeted killings than captures in counterterrorism efforts
